Terms of Use

These Terms of Service ("Terms") govern your access to and use of the cxcash.app wallet software and related websites (collectively, the "Service"), operated by cxcash.app ("we," "us," or "Operator"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

cxcash.app is a free, non-custodial software wallet. Cryptographic keys and recovery phrases are generated and encrypted in your browser on your device. We never receive, store, or have access to your private keys, recovery phrase (seed), or wallet password. No account registration is required to use the core wallet features. The Service is a companion product to CoinExchange.cash.

2. Eligibility

You may use the Service only if you:

• are at least 18 years of age (or the age of majority in your jurisdiction);
• are not located in, ordinarily resident in, or a national of a restricted jurisdiction (see our AML & Restricted Countries policy); and
• are not listed on any sanctions list maintained by the United States (including OFAC SDN), United Nations, European Union, United Kingdom (HMT), or similar authority, and are not acting on behalf of such a person or entity.

3. Your responsibilities

Because the wallet is non-custodial, you are solely responsible for safeguarding your recovery phrase, private keys, and wallet password. We cannot recover, reset, or retrieve them. Loss of your recovery phrase or password may result in permanent loss of access to your assets. You are solely responsible for all transactions you initiate, addresses you use, and backup of your wallet data stored locally on your device.

4. Not financial advice

The Service provides software tools only. Nothing on the Service constitutes investment, legal, tax, or other professional advice. Digital assets are volatile and risky. You should conduct your own research and consult qualified professionals before making financial decisions.

5. Third-party services

The Service may link to or integrate third-party services, including without limitation fiat on-ramp and off-ramp providers (such as MoonPay, Ramp, or Transak), token swaps via CoinExchange, decentralized applications via WalletConnect, and blockchain RPC or indexer providers. Those services are operated by third parties under their own terms, privacy policies, and compliance programs (including KYC/AML where applicable). We do not control and are not responsible for third-party services. Your use of them is at your own risk and subject to their terms.

6. Fees

The cxcash.app wallet software is provided free of charge. You remain responsible for network transaction fees (gas, mining fees, etc.) paid to blockchain networks, and for any fees charged by third-party providers (ramps, swaps, etc.) as disclosed by those providers.

7. Prohibited uses

You agree not to use the Service to:

• violate any applicable law or regulation;
• evade sanctions, export controls, or trade restrictions;
• engage in money laundering, terrorist financing, fraud, or other illicit activity;
• purchase, sell, or facilitate illegal goods or services; or
• interfere with or disrupt the Service or other users.

8. Risks of cryptocurrency

Digital assets involve substantial risk, including total loss of value, irreversible transactions, smart contract vulnerabilities, network failures, and regulatory change. You assume all risks associated with holding and transacting in digital assets.

9. CXCASH token

CXCASH is a token associated with the cxcash ecosystem and may be issued or referenced on networks such as Aztec. Token availability, network support, contract addresses, and features may change without notice. We make no representation regarding the value, legality, or suitability of CXCASH or any other token displayed in the wallet.

10. Intellectual property

The Service, including its name, branding, and software (excluding open-source components under their respective licenses), is owned by cxcash.app or its licensors. You receive a limited, non-exclusive, revocable license to use the Service for personal, lawful purposes in accordance with these Terms.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CXCASH.APP AND ITS OPERATORS, CONTRIBUTORS AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR DIGITAL ASSETS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

13. Indemnity

You agree to indemnify and hold harmless cxcash.app and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.

14. Governing law and venue

These Terms are governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. Any dispute arising out of these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration under the rules of a recognized international arbitration body, and will be conducted on an individual basis and not as a class or representative action.

15. Changes

We may update these Terms from time to time. We will post the revised Terms on https://cxcash.app with an updated "Last updated" date. Continued use after changes constitutes acceptance of the revised Terms.

16. Termination

We may suspend or terminate access to the Service (including blocking integrated third-party features) if we reasonably believe you have violated these Terms or applicable law. You may stop using the Service at any time by discontinuing use and deleting local wallet data from your device.
